Justin Wiater

Attorney Justin Wiater joined the Fitzsimmons Law Firm PLLC in January 2013. Justin brings extensive courtroom and jury trial experience to the firm's litigation and trial practice. Prior to joining the firm, Justin served as a criminal defense attorney in Columbus, Ohio and at the Public Defender Corporation for the First Judicial Circuit of West Virginia. During this time, Justin tried over 15 jury trials.
In 2005, Justin was retained as part of the trial team that tried a federal jury trial of insider trading, conspiracy, and obstruction of justice. The case was brought by the United States of America through the Department of Justice against six co-defendants in the United States District Court for the Southern District of Ohio. The indictment alleged that one of the defendants, a professor at the Ohio State University and board member of a local company, tipped off his close acquaintances of an impending buyout. After five weeks of trial, the jury reached a split verdict finding three defendants guilty and acquitting the other three defendants. Justin's defense team represented two of the three defendants found not guilty, successfully obtaining acquittals for his clients on all 12 counts of the indictment.
At the firm, Justin will concentrate his practice on general personal injury, car accident, motorcycle accident, and premises liability claims.
Justin attended Ohio University where he obtained a Bachelor of Arts degree in History in 2000. He obtained his Juris Doctor on 2003 from Capital University School of Law. During his time at Capital, Justin completed an externship with the Honorable Edmund Sargus, United States District Judge for the Southern District of Ohio.
Justin is admitted to practice law in Ohio, West Virginia, Pennsylvania and the United States District Court for the Southern District of Ohio.
Justin is a native of Wheeling, West Virginia. He is a member of the West Virginia Bar Association and Ohio County Bar Association, where he previously served as Secretary of the executive committee. When not practicing law, Justin enjoys playing golf at Oglebay Park and ice hockey in the WAHA senior league.
