Brent Wear
About
In 2004, Attorney Brent Wear joined the Fitzsimmons Law Firm PLLC. Since then, he has focused his practice on helping clients in cases involving personal injury and wrongful death, emphasizing helping victims of medical malpractice, birth injuries, toxic exposure, insurance coverage disputes, premises liability, car accidents and more.
Born and raised in Wheeling, West Virginia, Brent attended Wheeling Central Catholic High School and graduated in 1997. During his time at Wheeling Central, he was a four year starter in football and was a two-time all-state middle linebacker.
Following high school, Brent attended Allegheny College in Meadville, Pennsylvania and graduated in 2001. Upon graduating from Allegheny College, Brent continued his pursuit of education at the West Virginia University College of Law where he graduated with his Juris Doctor degree in 2004. Since joining our legal team, Brent has successfully represented clients involved in complex litigation resulting in numerous multi-million dollar settlements for those who have been negligently injured.
Brent has successfully tried medical malpractice and other injury claims obtaining verdicts for his clients, including obtaining multi-million dollar verdicts and settlements on behalf of victims of medical malpractice.
Beyond medical malpractice, another primary focus of Brent's practice is helping clients who have been wrongfully exposed to toxic substances. By successfully navigating mass tort and toxic tort claims, he has been able to help the wrongfully injured get the compensation they deserve. In fact, in one case he recently served as lead counsel in a toxic tort case on behalf of hundreds of plaintiffs in a suit against multiple corporate defendants that resulted in a $50 million settlement. Brent also has experience with class actions, having represented members of a community that were exposed to particulate matter. Brent and the Fitzsimmons Firm filed a class action lawsuit and sucessfully obtained a multi-million dollar class action settlement for members of the impacted community.
In addition, Brent has also represented clients involved in complex commercial disputes. Recently, Brent served as one of the lead attorneys in a complex commercial case involving parties from several states. After years of contentious litigation and extensive discovery conducted accross the country, Brent and other members of the Fitzsimmons Firm were instrumental in obtaining a $180 million settlement on behalf of their clients.
Brent has also been successful in obtaining substantial settlements on behalf of clients who have been victims of insurance company misconduct and fraud. In addition, he has obtained verdicts and settlements on behalf of clients seriously injured in car accidents.
Brent is proud to be admitted to practice not only in the states of West Virginia and Ohio, but also in the Supreme Court of the United States, the United States Court of Appeals for the Fourth Circuit and the United States District Courts for the Northern and Southern Districts of West Virginia.
Brent has also been appointed by the West Virginia Supreme Court of Appeals to serve as one of seven members of the West Virginia Board of Law Examiners, which evaluates educational background, credentials, character and fitness and competence of each applicant for admission to the practice of law in West Virginia under the Supreme Court Rules for Admission.
When he is not practicing law, besides spending time with his family, Brent enjoys co-hosting a weekly radio show, "The Legislative Watchdogs," on AM 1600 WKKX. During this show, he focuses on proposed legislation and legal issues that could potentially affect consumers' rights, as well as issues that affect workplace safety.
