Settlement Obtained in Workplace Electrocution Wrongful Death Against Mastec

Fitzsimmons Law Firm secured a settlement on behalf of the family of a
lineman killed as a result of high tension electrical injuries sustained
while working on a high voltage electrical transmission line against Mastec.
This was a "deliberate intention" claim brought against the
employer pursuant to W.Va. Code §23-4-2(d)(2)(ii) alleging that the
employer intentionally exposed the decedent to multiple unsafe working
conditions. Specifically, it was alleged that the employer violated multiple
Occupational Safety and Health Administration (OSHA) regulations, National
Electric Safety Code (NESC) standards, Institute of Electrical and Electronics
Engineers (IEEE) standards, and general industry standards which caused
and contributed to the workplace accident and resulting death. It was
also alleged that at the time of the accident the utility pole was badly
deteriorated and rotten and that the employer failed to require the use
of a baker board. At the time of the accident, the decedent was 34 years
old and survived by his three daughters.
