Robert Fitzsimmons has tried over 160 cases to verdict and has obtained some of the largest personal injury verdicts in West Virginia, including a $39 million verdict for insurance bad faith which was the largest bad faith verdict in West Virginia at the time. In 2010, Robert was named as one of the Top 75 Plaintiff's Lawyers in the country. Robert Fitzsimmons has been ranked among the Top 10 "Super Lawyers" on multiple occasions, including 2008 in which he was the #1 vote getter. Robert has been involved in many high profile cases throughout his career, including Mike Webster's disability claim against the NFL and WVU's claim against its former head football coach, Rich Rodriguez. He and his cases have been recognized in ESPN, HBO, Reader's Digest, GQ Magazine, The New York Times, and Men's Journal. He is currently co-director of the Brain Injury Research Institute (BIRI) which conducts research through brain autopsies to diagnose evidence of concussions.
Rocky Fitzsimmons was named as a 2012 Super Lawyer Rising Star in personal injury litigation. Rocky was previously named a West Virginia Rising Star in 2010 and 2011 for personal injury litigation and sports & entertainment law. Rocky has obtained several million dollar plus settlements on behalf on his client's for various personal injury claims. Rocky has also obtained significant settlements on behalf of his clients who have been mistreated by insurance companies. Rocky recently obtained a summary judgment against AIG Insurance subsidiary National Union Fire Insurance Co. of Pittsburgh, Pa. in the amount of $3.5 Million as a result of a wrongful denial claim. Rocky is also Co-Chairman of the Ohio County Democratic Party.
Brent Wear was named as a 2012 Super Lawyer Rising Star in personal injury litigation. Brent has obtained numerous multi-million dollar settlements on behalf of individuals who have been negligently injured or killed. Brent has also tried several injury and medical malpractice cases to verdict as co-counsel, including a $4.2 Million medical malpractice wrongful death verdict. Recently, Brent was appointed by the court as liaison counsel on behalf of a large group of plaintiffs in a chemical and toxic exposure case involving over 25 corporate defendants.
