Fitzsimmons Law Firm Obtains Jury Verdict in Medical Malpractice Trial

Fitzsimmons Law Firm attorneys Robert P. Fitzsimmons and Brent Wear obtained
a successful jury verdict in a medical malpractice wrongful death trial
last week on behalf of the family of a 43-year-old female who died as
a result of the defendant doctor's failure to diagnose and do a proper
cardiac workup. On February11, 2009, the patient was admitted to the Emergency
Room for chest pain. According to emergency room protocal, blood was to
be drawn at least 6 - 12 hours apart to perform proper cardiac enzyme
testing. However, the emergency room doctor drew blood at intervals of
only an hour and 20-minutes. The patient was discharged with a diagnosis
of "chest pain of unclear cause and bronchitis" and was not
scheduled or referred for a stress test as required by emergency room
policy. Had a stress test been ordered, it would have revealed that the
patient had significant blockage in her two main arteries. The patient
died several days later of an apparent myocardial infarction. She was
survived by her husband, adult son, three sisters, and a brother.
